On Monday, the Supreme Court has proposed three options for former president General (retd) Pervez Musharraf Treason case to record his statement and rejected the adjournment request by Musharraf’s lawyer.
“One option in Musharraf Treason case is that he should either appear in the next hearing. The second option is Musharraf should record his statement via a video link for the Musharraf Treason case and as a third option, Musharraf’s lawyer Salman Safdar should answer on his behalf,” said Chief Justice of Pakistan Justice Asif Saeed Khosa.
In his remarks, CJP Khosa observed that he “had an idea that Musharraf would be hospitalised” following the previous hearing.
The CJP asked what could be done if the accused was not appearing in the court.
“Is the court helpless if an accused in not appearing deliberately in the court,” said the Justice Khosa. “If the law is silent over the matter, the Supreme Court has the power to act given by Pakistan’s constitution.”
He said, “The government has its own priorities but the top court’s priority is only the supremacy of the law in the country.”
Earlier this month, the top court had sought a report from the special court regarding the delay in the high treason case and a reply from the government regarding measures taken for his return to the country.
PML Nawaz filed the treason case against Musharraf in November 2007.
Musharraf treason case:
The Pakistan Muslim League-Nawaz (PML-N) government had filed the treason case against Musharraf over the president’s imposition of extra-constitutional emergency in November 2007.
Earlier this year, head of the prosecution, Mohammad Akram Sheikh, tendered his resignation. In his resignation letter sent to the interior secretary, Sheikh expressed his inability to proceed with the case after the imminent change of government at the centre.
PML-N govt appointed Shaikh as the head of the prosecution in the case in November 2013.
The court rejected all the cases in March 2014 when former army chief appeared in the court.
On March 18, 2016, the former president left Pakistan for Dubai for medical treatment after his name and supreme court removed his name from the exit list of the airport.
A few months later, the special court had declared him a proclaimed offender and ordered the confiscation of his property owing to his no-show.
Later, on orders of the Supreme Court, Musharraf’s passport and identity card were also cancelled
